Terms for using PivotWrk and NVRWAIT AI.

1. Agreement to these terms

By using our websites, submitting information, purchasing a service, redeeming a promotion, or using services that link to these terms, you agree to these Terms & Conditions and our Privacy Policy. Separate proposals, statements of work, subscriptions, service agreements, promotional terms, or client contracts may include additional terms. If a signed agreement conflicts with these website terms, the signed agreement controls for that service.

2. Business identity

PivotWrk LLC operates PivotWrk and NVRWAIT AI. NVRWAIT AI is a business communications and automation service offered by PivotWrk LLC; references to “NVRWAIT AI,” “PivotWrk,” “we,” “us,” or “our” in these terms refer to PivotWrk LLC as applicable to the service being used.

3. Permitted use

You may use our websites and services only for lawful purposes. You may not misuse the services to harass, deceive, impersonate, defraud, violate privacy rights, send unlawful or unsolicited communications, interfere with systems, introduce malicious code, or violate applicable telecommunications, advertising, consumer-protection, intellectual-property, or data-protection laws.

4. NVRWAIT AI communications

NVRWAIT AI may use automated or AI-assisted technology to answer, route, summarize, schedule, or follow up on communications. AI-generated responses can be incomplete or inaccurate and should not be relied on as professional legal, medical, financial, emergency, or safety advice. NVRWAIT AI is not an emergency service and should not be used as a substitute for 911 or other emergency resources.

Where calls are recorded or transcribed, notice and consent will be handled as required by applicable law. Users and business customers are responsible for configuring and using communications features in a manner consistent with the laws that apply to their callers, recipients, and locations.

5. SMS messaging terms

When you separately opt in to receive recurring SMS messages from PivotWrk or NVRWAIT AI, you may receive customer-care messages, requested follow-ups, appointment reminders, account or service notifications, and other messages described at the point of consent. Message frequency varies. Message and data rates may apply.

Reply STOP to unsubscribe from recurring SMS messages. Reply HELP for assistance. Consent to receive recurring or marketing SMS messages is voluntary and is not a condition of purchase. Additional details are available in the NVRWAIT AI Messaging Terms.

6. Accounts, submissions, and accuracy

You are responsible for providing accurate information and for protecting access credentials associated with any account or portal. You may not submit information, files, instructions, or content that you do not have the right to use or share. You remain responsible for reviewing business-critical outputs, approvals, customer communications, and decisions before relying on them.

7. Intellectual property

PivotWrk websites, software, brand assets, interfaces, documentation, and original content are protected by applicable intellectual-property laws. Client ownership of custom deliverables is governed by the applicable proposal, contract, license, or statement of work. These website terms do not transfer ownership of PivotWrk or NVRWAIT AI technology, trademarks, systems, templates, or pre-existing materials.

7A. Founding 10 promotional package credit

The PivotWrk Founding 10 promotion provides each approved recipient with one individually issued, single-use promotional code worth up to $3,500 toward one eligible PivotWrk service package. Each code may be redeemed only once. Codes have no cash value, may not be resold or duplicated, and may not be combined with another promotion unless PivotWrk approves the combination in writing.

If the eligible package price is $3,500 or less, the promotional credit applies only up to the price of that package and does not create a cash balance, refund, or remaining credit. If the eligible package price exceeds $3,500, the client is responsible for the remaining package balance and any applicable taxes or separately stated third-party costs.

Redemption of a Founding 10 code is conditioned on the client accepting PivotWrk’s applicable service agreement, final project scope, payment terms, and promotional conditions before production is activated. As part of the Founding 10 promotional consideration, the client authorizes PivotWrk to feature the completed project as a PivotWrk case study, including approved project visuals, before-and-after presentation, deliverables, and non-confidential project information.

For a domain used with a Founding 10 project, the client remains the owner and registrant of the domain name. The client authorizes PivotWrk to manage and administer the domain on the client’s behalf through PivotWrk for service delivery, including DNS, website connection, technical settings, and renewal coordination. Unless the selected package expressly states otherwise, domain registration or renewal fees, hosting, paid software, advertising spend, premium assets, and other third-party costs are separate from the promotional credit.

8. Third-party services

Our services may rely on third-party providers for hosting, communications, payments, analytics, scheduling, authentication, or other functionality. Those services may be subject to their own terms and may experience interruptions, changes, or limitations outside our control.

9. Availability and changes

We may update, suspend, restrict, or discontinue website or service features when reasonably necessary for maintenance, security, compliance, provider changes, product development, or business operations. We do not guarantee that every feature will be uninterrupted or error-free.

10. Disclaimer of warranties

To the maximum extent permitted by law, websites and general digital-service features are provided on an “as is” and “as available” basis. Specific service commitments, support levels, deliverables, warranties, or remedies are governed by any applicable signed service agreement.

11. Limitation of liability

To the maximum extent permitted by law, PivotWrk LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the public website or general digital features. Any service-specific liability limits or remedies will be governed by the applicable signed agreement and mandatory law.

12. Governing law

Unless a signed agreement provides otherwise, these website terms are governed by the laws of the District of Columbia, without regard to conflict-of-law rules, subject to any non-waivable rights available under applicable law.

13. Changes to these terms

We may update these terms as our services or legal requirements change. The effective date above identifies the current version. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
